Re: Rhino Recall

The faulty design was NOT an A_C_C_I_D_E_N_T!

Re: Rhino Recall

Sigh  :?

So does anyone know how removing the rear sway bar is going to help prevent a rollover and improve handling? Would it help the suspension articulation in the rear for crawling? The spacers I understand - but I will bet almost everyone using the Rhino for recreation already has spacers or offset wheels.

Re: Rhino Recall

John Sand.....personally taking credit for what is NOT a recall, but a VOLUNTARY action on behalf of Yamaha and in cooperation with the CPSC.  There IS a difference......and it's a big one.  Don't pat yourself on the back too hard.....you might fall over, and then you'd have to find someone else to sue.

I found a great little article while I was doing some research on the internet.  According to this, the DRIVER of the Rhino that was involved in the death of Mr. Sand's daughter was found GUILTY of Vehicular Homicide.  Meaning.....HE was at fault for this accident - NOT the Rhino he was in control of at the time.  NOT Yamaha.  Also, it discredits what Mr. Sand has been saying for so long....that the Rhino just tipped over for no reason, at a slow rate of speed.  According to this, the driver was found to be engaging in HORSEPLAY at the time of the accident.  Here is the article.....

"Midland man gets three months jail time

NEWS JOURNAL STAFF REPORT

A Midland man was sentenced Tuesday in a Warren County court, bringing an end to a case that started when an 10-year-old girl lost her life.

Nils McElroy, 21, who previously pleaded to a misdemeanor charge of vehicular homicide, was sentenced Tuesday to 90 days in jail, ordered to pay a $1,000 fine and serve five years probation, according to court records.

McElroy was indicted Dec. 14 by a Warren County grand jury. He was found responsible for causing the death of Ellie Sand by way of negligence in operating a Yahama Rhino, an off-road vehicle. He was arraigned Jan. 3.

In late October, McElroy was at the home of Rob Osterhues, a friend who lives at 380 Ward Koebel Road in Oregonia. Most of the people at the social gathering, said Warren County Prosecutor Rachel Hutzel, were members of the same church. Part of the fun that day revolved around a Yamaha Rhino owned by Osterhues.

According to Warren County Chief Assistant Prosecuting Attorney Bruce McGary, McElroy drove the Rhino while taking others for rides. McGary said McElroy was engaging in general horseplay, which caused the Rhino to roll over.

Ellie Sand sustained fatal injuries during the rollover and died soon after the accident. She was the daughter of Tammy and John Sand of Lebanon.

The misdemeanor charge of vehicular homicide carries a maximum of six months in jail.

McElroy has a review hearing for costs and fines June 9 in front of Judge Jacqueline Handorf. He is represented by a public defender, attorney William R. Kaufman."

Also - no helmet, no seatbelt, and no parental supervision.  What are you so proud of, Mr. Sand?

I also ran across Mr. Sand's Youtube page, with some nice little video's of his daughter......and found out just a little TOO much about him......

John Sand's Youtube page

Am I out to discredit Mr. Sand?  Absolutely.  He has attacked my way of life (and all avid UTV'ers!) and I've pretty much had it.....

Re: Rhino Recall

Way to go GIRL! wink

Again, I hate to see any life get lost but it was an accident. With proper knowledge and a little reading of the manual this may of never happened. The owner of the vehicle should be the one responsible for who ever drives it anyway. roll

Re: Rhino Recall

Thanks.... smile

Well - it appears he has taken all of the porn off of his youtube page now.....but I saved the screenshot if anyone is interested in what Mr. Sand does when he's NOT trying to sue Yamaha.

And yes, it all boils down to accepting responsibility for our actions.  Simple lesson for most......impossible for a few.

Re: Rhino Recall

Here is a link to the page I saved before Sand deleted everything......it's minus the pics, because they didnt save for some reason, but that's not necessarily a bad thing......enough there to show how strange it is to have his daughter's videos on the same page as his lesbian porn faves......

Stay away, John.  And get some help!

Idiots like this just raised the cost of a new rhino about 150.00 again. Some people just can't handle responsibility.....
